1. Services

Killua Maintenance provides ongoing service and maintenance for residential and commercial solar and roofing systems. We serve customers across California's Central Valley and the surrounding markets from our office in Fresno, California.

Pricing, scope of work, schedule, warranty terms and any employment terms are set out in separate written documents that we sign with you. Nothing on this website is an offer, a contract, or a guarantee of price, response time, parts availability, or warranty coverage. Coverage is defined by your written service agreement or warranty.

2. Accuracy of Information

We work to keep this website accurate and current, but the content here is general information only. Product details, service descriptions, availability and regulatory requirements change. Nothing on this website replaces a written proposal, contract, warranty or offer signed by an authorized representative of Killua Energy Inc.

You agree that the information you give us is accurate and complete, and that the mobile phone number you provide belongs to you or that you are the authorized user of that number with permission to receive messages on it. If your number changes, or you give up a number, tell us promptly at info@killuaenergy.com or (559) 691-4028 so that we do not send messages to a person who never consented.

3. SMS Terms and Conditions

These SMS Terms and Conditions apply to the Killua Maintenance Notifications program. They are part of these Terms.

Consent

By providing your mobile phone number and checking the consent box on the Killua Maintenance text message sign up page, or by giving consent in writing to a Killua Maintenance representative, you give your express written consent to receive text messages from Killua Maintenance at that number, including messages sent using automated technology, about service visit scheduling, maintenance reminders, technician arrival notices, work order updates, and customer care.

Consent is not a condition of purchase. You are not required to agree to receive text messages in order to purchase any goods or services from us, to receive a quote or estimate, to be considered for a role, or to receive service under an agreement or warranty. Consent is collected when you submit the text message sign up form on this website and give consent on that form. We do not buy, rent or import phone number lists, and we do not message anyone who has not given us consent directly.

Message Content and Frequency

Messages in this program cover service visit scheduling, maintenance reminders, technician arrival notices, work order updates, and customer care. Message frequency varies. You will typically receive no more than 4 to 6 messages per month. Message volume depends on the stage of your project or application, so an active week may carry more messages than a quiet one. We do not send messages promoting anything unlawful, and we do not send messages about loans, debt collection, gambling, cannabis, firearms, tobacco, prescriptions or any other restricted category.

Cost

Killua Energy does not charge you for these messages. Message and data rates may apply. Check your plan with your mobile carrier if you are unsure what your plan includes.

Opting Out

You can stop the messages at any time. Reply STOP to any message from us. We will send one confirmation message acknowledging your request, and after that we will not send you further text messages from this program unless you sign up again. You may also opt out by emailing info@killuaenergy.com or calling (559) 691-4028. Opting out of text messages does not cancel any contract, project or service agreement, and it does not stop us from reaching you by phone or email about work already in progress.

Carriers and Delivery

Carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, your device, your coverage and your plan, and none of those are under our control. We cannot promise that any given message will arrive or arrive on time, so do not rely on text messages for anything urgent or safety related. Call us instead.

Supported Carriers

This program is supported by AT&T, Verizon Wireless and T-Mobile, together with their affiliates and the mobile virtual network operators (MVNOs) that run on their networks. Carrier support can change without notice, and we are not responsible for a carrier's decision to block, filter, delay or refuse a message.

Privacy

Information you give us in connection with this program is handled as described in the Killua Maintenance Privacy Policy, which is part of these Terms.

4. Acceptable Use

When using this website or our messaging program, you agree not to:

• Submit a phone number that is not yours and that you are not authorized to use
• Submit false, misleading or impersonating information, or submit information on behalf of another person without their permission
• Use automated tools to submit forms, scrape content, or send repeated requests to this website
• Attempt to gain unauthorized access to this website, our systems or another person's data
• Interfere with the operation of this website, or introduce malicious code
• Use this website or our messages for any unlawful purpose

We may decline service, remove content, or stop messaging a number if we believe these Terms have been violated.

5. Intellectual Property

This website and its content, including text, layout, graphics, logos and the names Killua Energy, Killua Solar, Killua Roofing, Killua Recruiting and Killua Maintenance, are owned by Killua Energy Inc. or used under license and are protected by United States law. You may view, download and print pages from this site for your own personal or internal business use, including keeping a copy of these Terms and the Privacy Policy. Any other use, including copying, republishing, framing or commercial redistribution, requires our written permission.

6. Disclaimers

This website is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Killua Energy Inc. disclaims all warranties of any kind relating to this website, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non infringement. We do not warrant that this website will be uninterrupted, error free, or free of harmful components.

This disclaimer applies to the website and to the messaging program. It does not limit, waive or disclaim any warranty we give you in a signed contract for work performed, and it does not affect any right you have under the California laws that govern licensed contractors.

7. Limitation of Liability

To the fullest extent permitted by law, Killua Energy Inc. and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or lost business opportunity, arising out of your use of this website or the text messaging program, whether the claim is based in contract, tort, negligence, strict liability or any other theory, even if we were advised that such damages were possible. This includes any damages arising from a message that was delayed, undelivered, filtered or misdirected by a carrier.

Where liability cannot be excluded, our total liability arising out of or relating to this website and the messaging program is limited to one hundred United States dollars. Nothing in this section limits liability that cannot be limited under California law, including liability for fraud, for willful misconduct, or for personal injury caused by our negligence, and nothing in this section limits our obligations under a signed contract for work performed.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute arising out of or relating to these Terms, this website or the text messaging program will be brought exclusively in the state or federal courts located in Fresno County, California, and you and Killua Energy Inc. each consent to the jurisdiction of those courts. If any provision of these Terms is held unenforceable, that provision will be limited or removed to the minimum extent necessary and the rest of the Terms will remain in effect.

9. Changes to These Terms

We may update these Terms. When we do, we will change the effective date at the top of this page and post the new version here. If a change materially affects the text messaging program, we will tell you before it takes effect. Continuing to use this website or the messaging program after a change takes effect means you accept the updated Terms. Your consent to receive text messages remains subject to the disclosures in effect when you gave it until you are notified of a change.
